The CharmSmith Shop sells vintage, antique, pre-owned and contemporary charms, jewellery and related items.

2. Using this website

You may use this website only for lawful purposes.

We take reasonable care to ensure that product descriptions, photographs, measurements, weights, materials and other information are accurate.

Many of our products are vintage, antique or pre-owned. They may show signs of age, previous wear, tarnishing, surface marks, repairs or other imperfections.

We aim to describe and photograph any notable wear, damage or alterations. Variations and age-related characteristics that have been clearly described or photographed do not necessarily mean that an item is faulty.

Product colours and appearance may vary slightly depending on photography, lighting and the screen or device being used.

Measurements and weights are approximate unless expressly stated otherwise.

Where information about a product’s age, origin or history is based on our knowledge and research rather than definitive documentation, it may be described as estimated, believed, attributed or approximate.

4. Gold, silver and hallmarks

We aim to describe the precious-metal content and hallmarking of each item accurately.

A product listing may state whether an item is:

  • Fully hallmarked
  • Partially hallmarked
  • Stamped
  • Tested
  • Unmarked
  • Believed to be a particular metal or purity

5. Availability

Many of our products are unique or one-of-a-kind and only one item may be available.

Adding an item to your basket does not reserve it. A product remains available for purchase until checkout has been completed and payment has been accepted.

Although we take reasonable steps to keep our inventory accurate, an item may occasionally become unavailable after an order has been placed.

Should this happen, we will contact you and issue a full refund for the unavailable item.

6. Placing an order

When you place an order, you are making an offer to purchase the selected product under these terms.

You will receive an order acknowledgement after submitting your order. This acknowledgement confirms that we have received the order but does not necessarily mean that it has been accepted.

A contract between you and The CharmSmith Shop is formed when:

  • We accept your payment; and
  • We send confirmation that the order has been accepted or dispatched.

We reserve the right to refuse or cancel an order before dispatch where reasonably necessary, including where:

  • A product is unavailable
  • The price or product information contains an obvious error
  • Payment has not been authorised
  • We cannot deliver to the supplied address
  • We reasonably suspect fraud or unauthorised activity
  • The order breaches these Terms of Service

Where we cancel an order after payment has been taken, we will issue a full refund for the cancelled item.

7. Customer information

You must provide current, complete and accurate information when placing an order.

You are responsible for checking that your:

  • Email address
  • Telephone number
  • Billing address
  • Delivery address

are correct before completing checkout.

Please contact us immediately through our Contact Us page should you notice an error after placing your order.

We cannot guarantee that an address or order can be amended after it has been processed or dispatched.

8. Prices

All prices are displayed in pounds sterling unless otherwise stated.

The price charged will be the price shown at checkout when the order is submitted.

Delivery charges and any other applicable charges will be displayed before you complete your purchase.

We may change our prices at any time, but changes will not normally affect orders that have already been accepted.

Should an obvious pricing error occur, we may contact you to offer the option of purchasing at the correct price or cancelling the order for a full refund.

9. Payment

Available payment methods will be displayed during checkout.

Payment must be authorised before an order can be processed or dispatched.

Payments are processed through Shopify and its supported payment providers. We do not directly store your complete card details.

We reserve the right to carry out reasonable checks or request additional information where necessary to prevent fraud or unauthorised transactions.

10. Delivery

Delivery options, charges and estimated timescales will be displayed during checkout or explained in our Shipping Policy.

Estimated delivery dates are not guaranteed. Postal, courier, customs or other delays may occasionally occur outside our reasonable control.

You must provide a complete and accurate delivery address.

11. Ownership and responsibility

Ownership of a product passes to you once we have received payment in full.

Responsibility for the product passes to you when it is delivered to you, or to another person identified by you to receive it.

Where you arrange your own independent delivery provider, responsibility may pass when the item is handed to that provider.

12. Cancelling an order

Please contact us as soon as possible should you wish to cancel an order before it has been dispatched.

We will make reasonable efforts to cancel it. However, once an order has been dispatched, you will need to follow the returns process.

For most online purchases, consumers may notify us that they wish to cancel within 14 days of receiving the item and then have a further 14 days to return it.

To exercise your right to cancel, contact us through our Contact Us page and provide your name and order number.

13. Returns and refunds

Returns must be made in accordance with our Returns and Refunds Policy.

Unless an item is faulty, damaged, incorrectly supplied or not as described, you will normally be responsible for the return postage cost.

We recommend using a tracked and adequately insured service when returning valuable jewellery.

We may reduce a refund where an item has been handled beyond what is reasonably necessary to inspect its nature, characteristics and condition.

Nothing in these terms limits your rights where a product is faulty, not as described or otherwise fails to meet the requirements of UK consumer law.

14. Faulty, damaged or incorrect products

Please inspect your order promptly after delivery.

Should an item arrive:

  • Damaged
  • Faulty
  • Incorrect
  • Materially different from its description

please contact us through our Contact Us page as soon as reasonably possible.

Include your order number, an explanation of the issue and photographs where appropriate.

We will review the matter and provide an appropriate remedy in accordance with your statutory rights.

15. Personalised or altered products

Where we offer a product that is made to order, personalised, engraved, resized or altered specifically at your request, your normal change-of-mind cancellation rights may not apply.

This does not affect your rights where the product is faulty, damaged or not as described.

Any applicable restriction will be explained before the order is completed.

16. Promotions and discount codes

Promotional offers and discount codes may be subject to additional terms, including:

  • A closing date
  • A minimum order value
  • Product exclusions
  • One use per customer
  • Restrictions on combining offers

Unless otherwise stated, discount codes cannot be exchanged for cash or applied retrospectively to an order that has already been completed.

We reserve the right to withdraw or amend a promotion where reasonably necessary.

17. Intellectual property

Unless otherwise stated, all website content—including photographs, product descriptions, branding, graphics, logos and written material—is owned by or licensed to The CharmSmith Shop.

You may view and use the website for personal, non-commercial purposes.

You must not copy, reproduce, modify, distribute, publish, sell or commercially exploit our content without prior written permission.

18. Reviews and submitted content

Where you submit a review, photograph, testimonial or other content, you confirm that:

  • It is accurate and relates to your genuine experience
  • You have the right to submit it
  • It does not infringe another person’s rights
  • It is not unlawful, abusive, misleading or defamatory

We may refuse or remove submitted content where it breaches these requirements.

We will not knowingly publish fake or misleading customer reviews.

We do not exclude or limit liability where doing so would be unlawful.

This includes liability for:

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Products purchased from our consumer store are supplied for private use. We are not responsible for business losses, loss of profit, loss of revenue or loss of business opportunity arising from a consumer purchase.

We collect and process personal information in accordance with our Privacy Policy.

By placing an order, you acknowledge that we need to use certain personal information to process payment, fulfil the order, arrange delivery, communicate with you and meet our legal obligations.

The version applying to an order will normally be the version published when that order was placed.

Should we delay in enforcing a right under these terms, this does not mean that we have waived that right.

26. Governing law

These terms are governed by the laws of England and Wales.

Consumers living in Scotland or Northern Ireland may also benefit from mandatory protections and may bring proceedings in the courts of the part of the United Kingdom in which they live.

Customers living outside the United Kingdom may retain any mandatory consumer protections provided by the law of their country of residence.
